The Chairman of the Council of Ministers
On the report of the Minister of National Defence,
Having regard to Article 47 of the Constitution ;
Having regard to the decree of 7 February 1947 fixing the distribution of powers in matters of national defence ;
Having regard to the decree of 24 April 1948 relating to the exercise of the powers of the President of the Council in matters of national defence ;
Having regard to the decree of 16 September 1948 on the exercise of the powers of the Minister for National Defence ;
Having regard to the opinion issued by the National Defence Committee at its meeting of 1 October 1946,
Decree:
Art. 1. - an institute for advanced national defence studies is hereby created, the purpose of which is to prepare senior civil servants, general or senior officers and persons who are particularly qualified from an economic or social point of view to hold the most senior positions in the bodies responsible for the preparation and conduct of war.
Art. 2 - the Institut des hautes études de défense nationale is placed, by delegation of the Chairman of the Board, under the high authority of the Minister of National Defence (National Defence Staff).
The work programmes and their conclusions are submitted to the Minister of National Defence.
Art. 3 - The director of the institute is a general officer or senior civil servant. He or she is assisted by one or more deputies; if one of them is a member of the military, he or she must belong to a different army from the one to which the director may belong.
The Director and Deputy Directors are appointed by decree on the proposal of the Minister for National Defence.
Art. 4 - The Director of the Institute is assisted by a Development Council, chaired by :
A representative of the Chief of the General Staff of National Defence ;
Four general officers from different armies;
A representative of the Minister of Foreign Affairs, the Minister of the Interior, the Minister of Finance and Economic Affairs, the Minister of National Education, the Minister of Public Works and Transport and the Minister of Industry and Trade;
A representative of the Scientific Action Committee ;
The Director of the Centre for Advanced Administrative Studies ;
A person who is particularly qualified from an economic or social point of view.
Art. 5. Auditors are chosen in principle from the major government bodies, general or senior officers with at least the rank of lieutenant-colonel or frigate captain, civil servants from central government departments, the Seine Prefecture and the Police Prefecture with at least the rank of 2nd class administrator and persons with particular economic or social qualifications.
They are appointed by decree, on the proposal of the Minister of National Defence and, where applicable, the Minister or Prefect to whom they report, after consulting the Director of the Institute.
Art. 6. military and civilian personnel seconded to the Institute, either to form part of its staff or to attend courses as auditors, shall continue to be administered by the ministries to which they belong.
Expenses relating to pay, salaries and related allowances are borne by the said ministries, with the exception of travel expenses relating to trips organised by the Institute.
Art. 7 - expenditure resulting from the application of this decree other than that referred to in article 6 will be incorporated into the budget of the national defence staff.
Art. 8. The opening date and duration of the sessions are set by order of the Minister of National Defence.
Art. 9. the decree of 14 August 1936 creating the national defence college is repealed.
Art. 10. the ministers and secretaries of state are each responsible for the execution of this decree, which will be published in the Journal officiel de la république française.
